MSDS is the non-European term for a SDS, commonly used by North Americans. Non-EU SDS are non-compliant to the REACH 453/2010 regulations and will need to be translated into the new format for resupply in the EU.

SDS stands for Safety Data Sheet. It is a legally required document, consisting of 16 sections and numerous subsections highlighting, amongst others, the hazards, labelling requirements, hazardous composition, first aid measures, transport requirements etc….

A Safety Data Sheet is required for all substances / mixtures which contain are hazardous, or contain hazardous constituents in concentrations above their respective thresholds. These are listed in the DPD/CLP regulations. If in doubt, Chemi-Compliance Limited will gladly verify the need for a SDS before doing the work.

There is no short answer, but in effect you need to consider its implications under REACH, CLP notification requirements, ensure compliance to labelling, packaging and transport requirements, whether the substance is restricted for import/export under 689/2008 EC... I want to import a product, what do I need to do?

If the product is being exported to a country within the EU it is fairly easy. Compliance to the CLP/DPD regulations is required (i.e. labels in English and the language of the recipient country), a SDS in the language of the recipient country (and English separately), compliance to transport requirements, and check against the import/export restrictions under 689/2008 EC.
